§ 9:963. Issuance of teen club license.

  • (a)

    Except as provided in subsection (b) of this section, the alcoholic beverage control office shall grant a license or a renewal license to those applicants who have submitted an application in accordance with the terms of this section and who demonstrate their ability to operate a teen club in accordance with the specifications set forth in this section, the code, and all other applicable laws and regulations.

    (b)

    The alcoholic beverage control office shall not issue a license if:

    (1)

    Any person listed on the application as an owner, officer, managing agent, or employee of the teen club, within the preceding ten years, has been convicted of, been incarcerated for, or has been under probation or parole supervision for a:

    a.

    Felony, or

    b.

    Nontraffic criminal misdemeanor or misdemeanor involving drugs, liquor, prostitution, public indecency, minors, a sexual offense, violence or weapons; or

    (2)

    The teen club has been deemed a nuisance by the city-parish in accordance with title 12 of the Code, or has been declared a nuisance or blighted property in any adjudicative process.
