§ 8:16. Examination and qualifications.
(a)
No person shall be licensed as a contractor until he has passed an examination approved by the board in a category of his choosing. Once a contractor has qualified to perform work in one category, he must restrict his work to that category until such time as he can qualify for a more restrictive license. A contractor can qualify for a license in a different category at any time by taking the examination for the new category, by paying a one hundred dollar ($150.00) examination fee. Any contractor or his employee misrepresenting his license classification shall be subject to the penalties of section 8:19.
(b)
All licenses issued shall be issued to the person who qualified for the license. A license holder leaving one business for another must make application for a change in business name, and comply with the regulations governing licensed contractors (see sections 8:13 and 8:14). No reexamination will be required if he has already taken one. Licenses shall be categorically divided as follows:
(1)
Class A: All phases of heating, air conditioning, ventilation and refrigeration.
(2)
Class B: Limited to small commercial equipment to ten (10) tons, all residential air conditioning and heating, including apartments and mobile homes.
(3)
Class R: Commercial refrigeration installation and service of the following: walk-in coolers, ice makers, reach-in coolers and display cases, etc.
(4)
Class FE: Installation and service of fire suppressant systems associated with kitchen equipment.
(c)
Qualifications for examination and license: The applicant for a license shall submit an application properly completed on a form furnished by the chief air conditioning inspector and accompanied by examination fee and shall meet the following minimum requirements:
(1)
Be a citizen of the United States.
(2)
Be twenty-one (21) years of age or older.
(3)
Must have five (5) years' supervised working experience in the category for which he is applying.
(d)
An application for a examination shall be accompanied by an examination fee of one hundred fifty dollars ($150.00). The initial license fee and/or annual renewal fee will be determined by the class of license applied for.
(e)
Examinations shall be held at such time, not less than twice a year, and places as the board may designate, shall be written and be sufficient to test the applicant's knowledge in the class of license for which he is applying.
(f)
Any applicant who fails to pass the first examination shall be permitted to take a reexamination at the next regular examination; however, should the applicant fail to pass such reexamination he shall not again be examined until after a delay of at least six (6) months. Should the applicant fail to pass the second reexamination, he shall not again be examined until after a delay of at least one (1) year.
(g)
All contractors doing installation work on fire extinguisher systems shall have a current certificate of certification from a fire extinguisher company when applying for license. A current certificate must be obtained and presented each year when obtaining license for the ensuing year. Work performed or service of an existing fire extinguisher system other than the company which has issued the certificate shall be covered by the contractor's general liability.
