§ 10:215. Taxicab control board.

  • (a)

    Creation. There is hereby created a taxicab control board for the city-parish, such board to be composed of seven (7) members designated as follows:

    (1)

    Director of aviation, or his designee.

    (2)

    Chief of police of the city, or his designee.

    (3)

    Sheriff of the parish, or his designee.

    (4)

    Director of finance, or his designee.

    (5)

    Director of public works, or his designee.

    (6)

    Appointee by the mayor-president of the city-parish.

    (7)

    President of Visit Baton Rouge, or his designee.

    The taxicab control board shall elect its chairman. The board may elect such other officers as it deems necessary, including a secretary, who need not be a member of the board.

    (b)

    Rules of procedure; meetings; voting. The board may adopt rules of procedure; but, in any event, the board shall hold regular meetings at a time and place to be designated by the board. Such other meetings may be called and held as may be deemed necessary for the transaction of business in the manner provided for in the rules of procedure.

    No permit shall be issued by the board unless the applicant meets all statutory and other legal requirements and has received the affirmative vote of a majority of the members of the board.

    (c)

    Quorum. A majority of the board shall constitute a quorum, and no business shall be transacted by the board unless a quorum is present.

    (d)

    Rules and regulations, board authority to adopt. The board shall have the power to adopt such rules and regulations with regard to the issuances of permits as may be required or necessary in order to carry out the purpose and intent of this section, provided such rules and regulations are not inconsistent with the plan of government of the city-parish and subject at all times to the superior authority of the council.

    The authority conferred by section 10:214 shall be exercised by the taxicab control board herein created. Any conflict between the authority granted by this section to the taxicab control board and that exercised by other agencies of the city-parish government shall be resolved in favor of the exercise of such authority by the taxicab control board herein established, subject at all times to the superior authority of the council.

    (e)

    Appeals from board decisions or actions. Any person aggrieved by any decision or action of the board may take a devolutive appeal therefor to the district court within fifteen (15) days of written notification of the decision or action. The decision of the board shall be final unless appealed within the time and in the manner set forth above.
