§ 6:406. Requirements of owners and occupants.(Parish)

  • Every owner, and occupant, of any building, house, structure or grounds within the limits of a legally created and existing garbage district of the parish, where garbage, as defined in section 6:401, accumulates, may have such garbage collected and disposed of by the department of public works only if such garbage is:

    (1)

    Placed in a container or containers therefor of not less than five (5) nor more than thirty (30) gallons' capacity, constructed of some substantial metal or plastic material, with a tight-fitting lid or cover which will exclude rain or flies, and with handles sufficiently strong for workmen to empty conveniently. No container, with contents, shall weigh more than seventy-five (75) pounds. The can or container shall be maintained in as sanitary condition as possible, in view of the use to which same is put and shall be thoroughly cleansed as needed by washing, scalding or otherwise.

    All commercial establishments, institutions and schools which need more than the equivalent of two (2), thirty-gallon containers for disposal of garbage and all apartment buildings or groups of buildings containing eight (8) or more units may have such garbage collected and disposed of by the department of public works only if it is placed in containers of one yard capacity which are mounted on wheels, equipped with self-closing lids, and designed to be dumped mechanically by attachments on the rear of garbage trucks.

    In lieu of garbage containers as herein provided, the use of commercial type disposable bags is permissible, provided such bags meet specifications approved by the waste disposal committee.

    (2)

    The lids or covers of all cans or containers shall at all times be kept secure and fastened so that flies and other insects, as well as dogs and scavengers, may not have access to the contents thereof.

    (3)

    Containers and cans for the collection of garbage substances must be placed either on the neutral ground or within the premises immediately adjacent to the street or sidewalk, and not less than five (5) feet from traveled surface of streets if no curb or sidewalks are provided. No can or container shall be placed on the street or sidewalk or in any ditch along the street, nor shall any can or container be allowed to remain on the neutral ground or other place for collection except between the hours from 4:00 p.m. the day preceding the scheduled pickup and 6:00 a.m. the day after the pickup.

    The placing of such garbage for collection in any container, manner, or place other than as specified in the above paragraph is prohibited and such is hereby made a violation of this part.

    Should the city and parish enter into a contract with a private contractor for the collection and disposal of garbage, trash, bulky waste and litter, the terms and conditions of that contract shall take precedence over the provisions of this section, including but not limited to the definitions of all items of the contract.
