§ 6:391. Ownership of garbage, trash, refuse and rubbish on city disposal sites vested in city and declared public property.(City)

  • (a)

    The ownership of all garbage, trash, refuse or rubbish material collected by the city or deposited on the city disposal site, either by the city or under contract with the private contractor, shall be vested in the city; and such material is hereby declared to be public property. No person shall go upon the city disposal site for the purpose of depositing materials thereon, nor shall any person deposit materials on the city disposal site except in accordance with rules and regulations established by the director and approved by the refuse committee or the council.

    (b)

    No person shall salvage, collect, remove or dispose of any garbage, refuse, trash or rubbish material deposited on the city disposal site.

    (c)

    The city shall provide a disposal site for private collectors or private individuals who are actual producers of garbage, refuse, trash or rubbish who desire to use the public disposal site provided that they conform or abide by such conditions, rules, regulations as may be established by the council.

    (d)

    Any private disposal site shall conform to the rules and regulations applicable to the public disposal site contained in this part or other applicable laws or regulations.
