§ 6:388. Director of public works to make other regulations, routes and schedules.(City)
(a)
In addition to specific authority granted to the director of public works elsewhere in this part, the director is authorized to promulgate, make and publish reasonable rules and regulations for the purpose of the proper administration and enforcement of the provisions of this part; provided that the rules and regulations shall not be inconsistent with the provisions of this part or other law or the constitution of this state; and provided further that such rules and regulations shall be approved by the council after which they shall have the full force and effect of law. All rules and regulations in force prior to this amendment shall remain in force and effect, unless they are in conflict with this part.
(b)
Until otherwise directed by the council, the director of public works is hereby authorized to establish appropriate routes and schedules providing for the pickup of garbage within the residential areas of the city on the basis of not more than two (2) pickups per week. Garbage pickup from commercial establishments by collectors shall be at least twice a week or more frequently, taking into consideration proper sanitation of the commercial areas and the protection of the public health. Trash collection in the residential areas shall be on the basis of one (1) day a week, in accordance with schedules and routes to be established by the director of public works. Routes and schedules for the pickup of garbage and trash by the city, as herein authorized, shall be established by the director of public works, who shall give appropriate public notice thereof in order that all persons affected may be fully informed concerning the routes and schedules so established. Collection from commercial establishments by private collectors shall be on the basis which is mutually agreeable to the commercial establishment and the collector; however, the collection must be of such frequency to maintain proper sanitation and protect the public health.
(c)
Should the city and parish enter into a contract with a private contractor for the collection and disposal of garbage, trash, bulky waste and litter, the terms and conditions of that contract shall take precedence over the provisions of this section, including but not limited to the definitions of all items of the contract.
