§ 1:701. Established; authority for purchases.

  • (a)

    The purchasing division, established by the plan of government (sections 4.07—4.12), is responsible for the purchase of materials, supplies, equipment and contractual services for the various user agencies of the city and parish. All purchases and contracts shall be made by the purchasing division in accordance with applicable state statutes, as supplemented by these regulations.

    (b)

    Public works contracts and purchases of materials or supplies exceeding the threshold established, in accordance with the latest revision of R.S. 38:2181—38:2296, shall be awarded by the purchasing division.

    (c)

    For public works contracts with an estimated value of twenty-five thousand dollars ($25,000.00) but not exceeding the threshold established, in accordance with the latest revision of R.S. 38:2212, written quotations shall be solicited from at least three (3) firms. Although not required, projects may be advertised at the discretion of the purchasing agent. All quotations will be received by the purchasing division, and contracts will be awarded by the purchasing division.

    (d)

    Purchases of material supplies exceeding five thousand dollars ($5,000.00) and up to thirty thousand dollars ($30,000.00) shall be made by the purchasing division after obtaining at least three (3) telephone, facsimile, or written quotations. As a minimum, a written confirmation of the accepted offer shall be obtained and made a part of the purchase file for purchases exceeding five thousand dollars ($5,000.00). With approval of the purchasing division, user agencies may issue direct payments for items in this category provided quotations are received by the purchasing division as outlined above.

    (e)

    Purchases of materials and supplies costing five thousand dollars ($5,000.00) and less may be made directly by the user agencies as hereinafter provided in section 1:707.

    (f)

    Contracts for services (professional, consulting, personal, etc.) shall be obtained in accordance with current city-parish regulations, ordinances, or procedures with regard to the various types and levels of services. In the event the state enacts future legislation governing these types of services, such legislation shall supersede local regulations to the extent required by law.

    (g)

    The purchasing division may purchase from commodity contracts made by the central purchasing agent of the state, in accordance with R.S. 39:1702, when the purchasing agent determines such purchases to be in the best interest of the city-parish. User agencies may also purchase from these contracts upon prior approval of the purchasing division.

    (h)

    Unless otherwise noted, all terms used in this part, such as "public work," "work," etc., shall have the same meaning as defined in R.S. title 38.

    (i)

    This part shall be supplemental to the provisions of the plan of government and the general laws of the state relating to public contracts; and all ordinances or resolutions in conflict herewith are hereby repealed. Any conflict between this part and applicable state statutes shall be resolved in favor of the current state statutes.
