§ 13:1014. Smoking prohibited.

  • (a)

    "Smoking" is defined as the possession of any lighted products, the fumes of which may be inhaled by any person.

    (b)

    It shall be unlawful for any person to be smoking, either by pipe, cigarette or cigar, any tobacco or any other substitute in the following areas:

    (1)

    In buses traveling the streets of the city, the services of which are available to the public upon the payment of a fare;

    (2)

    In elevators or stairwells located in buildings owned or controlled by the city-parish;

    (3)

    In those buildings of the Centroplex located at 275 South River Road in Baton Rouge known as the Arena, Exhibit Hall and Theatre; provided, however, that this subsection shall not apply under the following circumstances:

    a.

    Smoking within the office and concourse areas;

    b.

    Smoking during a function for which a permit authorizing smoking has been granted by the chiefs of the police and fire departments.

    (4)

    In the Baton Rouge Metropolitan Airport Terminal Building; provided that this subsection shall not apply to smoking within office areas.

    (c)

    Whoever is found guilty of a violation of this section shall be fined not more than five hundred dollars ($500.00) and imprisoned in the jail for not more than six (6) months, or both.
