§ 13:1013. Sale of tobacco to persons under eighteen years of age prohibited; exception.
(a)
It shall be unlawful to sell, barter or exchange by wholesale or retail tobacco in the form of cigarettes, cigars or any other form to any person under the age of eighteen (18) years.
(b)
It shall be unlawful to sell, barter or exchange by wholesale or retail paper products designed to roll or form cigarettes of any type to any person under the age of eighteen (18) years.
(c)
The provisions hereof shall not apply to the sales of tobacco to minors engaged in business as merchants for the purpose of resale of same.
(d)
Any person violating the provisions of subsection (a) and (b) shall be guilty of a misdemeanor and, on conviction thereof, shall be punished by fine of not less than twenty-five dollars ($25.00) nor more than one hundred dollars ($100.00) or by imprisonment for a term not to exceed sixty (60) days, or both, in the discretion of the court.
