§ 11:246. Riding motorcycles, three-wheelers, four-wheel all-terrain vehicles or go-carts on vacant lots or tracts of land prohibited in designated locations.

  • (a)

    No person shall operate a motorcycle, three-wheeler, four-wheel all-terrain vehicle or go-cart upon vacant lots or tracts of land within the city limits of the city or upon vacant lots or tracts of land within a recognized subdivision of the parish or within five hundred (500) feet of a recognized subdivision of the parish.

    (b)

    No person shall modify the exhaust system of a motorcycle, three-wheeler, four-wheel all-terrain vehicle or go-cart in a manner which would amplify or increase the noise emitted by such vehicle above that emitted by the muffler originally installed on such vehicle; nor shall any person operate a motorcycle, three-wheeler, four-wheel all-terrain vehicle or go-cart having such a modified exhaust system except on legally permitted riding tracts.

    (c)

    Every motorcycle, three-wheeler, four-wheel all-terrain vehicle or go-cart shall at all times be equipped with a muffler in good working order; and no person shall use a muffler cutout, bypass, or similar device upon a motorcycle, three-wheeler, four-wheel all-terrain vehicle or go-cart while operating the motorcycle, three-wheeler, four-wheel all-terrain vehicle or go-cart in the city or parish except on legally permitted riding tracts.

    (d)

    Any person riding a motorcycle, three-wheeler, four-wheel all-terrain vehicle or go-cart upon his or her own property, or any person riding such vehicles on property with the permission of the owner thereof, shall be exempt from the provisions of subsection (a) above. This exemption does not preclude charges being filed under title 12, chapter 2 (Noise Ordinance) of this Code (section 12:100 et seq.).

    (e)

    Any governmental agency using such vehicles in the performance of its duties, particularly the East Baton Rouge Parish Mosquito Abatement District, is exempt from the provisions of subsection (a) above.

    (f)

    Whoever violates the provisions of this section shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) or imprisoned not more than ninety (90) days at the discretion of the court.
