§ 10:419. Insurance required.
(a)
Before any permit is issued hereunder, the applicant must file with the finance director and the department of EMS a policy of public liability insurance issued by an insurance company qualified to do business in the state, which shall contain the following conditions and stipulations:
(1)
The term of such insurance policy shall be for a period of not less than one (1) year.
(2)
The insurance policy shall provide limits of liability consistent with good business practices and accepted by the department of EMS and the finance director to be adequate coverage.
(3)
Such policy shall by its terms provide that it may not be canceled except after ten (10) days' written notice thereof to the finance director.
(b)
Any owner or operator of an air ambulance who fails to secure any policy of liability insurance prior to cancellation of an existing one shall automatically and without notice or hearing suffer suspension of his/her permit until such time as such insurance policy has been filed with the finance director and the department of EMS.
(c)
Any person who operates an air ambulance service without having such liability insurance in force shall be guilty of a violation of this chapter and shall be punished as hereinafter provided.
