§ 10:8. Railroad derailment early warning system.

  • (a)

    The railroad owners, operators and personnel shall notify the city police department and the sheriff's office immediately in the event of any railroad derailment, involving hazardous commodities or which creates hazardous conditions. These law enforcement offices shall then immediately notify the fire department of the derailment. The notifications shall be by most expeditious method and include the location and available details of the derailment.

    (b)

    If in the opinion of the fire department the derailment poses a threat to life or property, the fire department shall alert civil defense and the Greater Baton Rouge Mutual Aid of the threat and in the event that the derailment is an emergency of such magnitude that it could be harmful to life or property, the civil defense will be activated in order to act to preserve life and property and shall coordinate its activities with the law enforcement offices in order to alleviate the condition as promptly as possible.

    (c)

    Every person convicted of a violation of this section shall be punished by a fine of not more than two hundred fifty dollars ($250.00) and/or imprisonment for not more than ten (10) days for each offense.
