§ 9:1214. Prohibited practices.

  • A pawnbroker shall not:

    (1)

    Accept a pledge from a person under the age of eighteen (18) years.

    (2)

    Make any agreement requiring the personal liability of a pledgor in connection with a pawn transaction.

    (3)

    Accept any waiver, in writing or otherwise, of any right or protection afforded a pledgor under this chapter.

    (4)

    Fail to exercise reasonable care to protect pledged goods from loss or damage.

    (5)

    Fail to return pledged goods to a pledgor upon payment of the full amount due the pawnbroker of the loan transaction.

    (6)

    Make any charge for insurance in connection with a pawn transaction.

    (7)

    Accept in pawn or purchase any article usually manufactured with a serial number on which the serial number has been obliterated, defaced, or otherwise altered without the prior written permission of the police department, which shall be obtained by the owner's making affidavit of ownership with the department on a form to be established by the department.

    (8)

    Sell, trade or dispose of any jewelry, precious or semiprecious metals or stones pledged to him as collateral security for loans, or purchased on condition of selling same back at a stipulated price upon maturity of the loan, before a lapse of twelve (12) months from the date of the transaction. Neither shall any pawnbroker sell, trade or dispose of any other property pledged as collateral security for loans, or purchased on condition of selling same back at a stipulated price upon maturity of the loan, before a lapse of three (3) months from the date of the transaction.

    (9)

    Sell any item which he has purchased before a lapse of thirty (30) days from the date of the purchase.

    (10)

    A pawnbroker shall neither open his place of business before the hour of 7:30 a.m. nor keep it open after the hour of 7:00 p.m., except Saturdays and the month of December, during which time the hour of 7:00 p.m. shall be extended to 10:00 p.m.
