Chapter 7. EATING AND DRINKING ESTABLISHMENTS |
§ 6:610. Markets.
In addition to the requirements of section 6:608, the following regulations shall apply to markets:
(1)
All food and drink not contained in glass or metal containers shall be stored at least six (6) inches above the floor and in such a manner as to fully protect the food or drink from contamination.
(2)
All establishments selling or offering for sale fresh meats or fresh produce shall install, as a minimum, one (1), two (2) compartment sink; any establishment engaged in ready-to-eat food processing or prepacking of foods, shall also, and in addition thereto, install a lavatory in the work area.
(3)
The loading, unloading or transportation of any food or drink shall be carried on in such a manner as to adequately protect the food or drink from dust, insects and other contamination. The unloading and placing of any food or drink outside the confines of the building or any place of business is prohibited unless such unloading is carried out in a manner approved by the director as complying with the provisions of this chapter.
(4)
In rooms where fresh meats or produce are processed or stored, all doors, windows, or portal openings to the outside or an unprotected area shall be self-closing. All readily perishable food or drink, including precooked hams, shall be stored and held at a temperature below fifty (50) degrees Fahrenheit or above one hundred fifty (150) degrees Fahrenheit. The displaying of any such food or drink above or outside the cold zone of any refrigerator is prohibited. Frozen food allowed to thaw shall not be refrozen.
(5)
All prepacked food or drink shall be labeled in accordance with the laws of the state. The introduction into trade or receipt of improperly labeled food or drink shall constitute a violation of this chapter.
(6)
Markets selling or offering for sale produce from an unenclosed area shall keep flies and other insects under control. Parking areas of such establishments shall be paved, hard-surfaced, or finished in such a manner as to prevent excessive dust.
