§ 6:422. Creation, maintenance of private dumps prohibited without required permits.(Parish)

  • (a)

    It shall be unlawful for any private person to establish or permit the establishment of a private dump on any public property or on any property privately owned or controlled by him within the parish, with the exception of the industrial areas, as defined in the Plan of Government, without first having obtained a permit for such operations from the department of public works. Issuance of this permit is subject to the approval and concurrence of the department of public works, the health unit and the capital improvements committee and metropolitan council.

    (b)

    Each day such violation is permitted to continue shall constitute a separate offense, and shall be punishable as provided by section 6:420.

    (c)

    For purposes of this section, a "private dump" shall mean any place or landfill which is not maintained and/or controlled by the council and which is used for disposal or collection of garbage, trash and other waste matter, refuse, rubbish or discarded materials.

    (d)

    Persons required to obtain permits for maintenance of a private dump hereunder shall pay to the parish the amount of one hundred dollars ($100.00) for each year the private dump is permitted to exist. All permits will run concurrently from February 1 to January 31 of the following year. Initial permits issued within the calendar year will be assessed a pro rata share of the annual permit fee, on a monthly basis. Renewal permits will be assessed at the full permit fee. Permittees who are delinquent more than two (2) months must reapply for a landfill permit.

    (e)

    Private dumps, as defined herein, shall be subject to periodic inspection at the discretion of the department of public works, the health unit and the capital improvements committee and metropolitan council.

    (f)

    The department of public works employees, investigators, inspectors, or employees of the police department and employees of the sheriff's department shall have the authority to identify the owners, by any available means, of any garbage, trash, refuse or rubbish material dumped or discarded at any site other than the Devils Swamp Landfill or other duly approved waste disposal site. The owner of the illegal dumping shall have twenty-four (24) hours to clean the dumping site and haul the material to the Devils Swamp Landfill at his expense. In areas where "No Dumping" signs are posted, the owner of any garbage, trash, refuse or rubbish material that can be owner identified shall be responsible to clean the entire "No Dumping" site at his expense and haul the material to the Devils Swamp Landfill within twenty-four (24) hours of notification, and shall be subject to the penalties set forth in section 6:420.
