§ 6:302. Milk and milk products produced and pasteurized beyond the limits of the police jurisdiction of the city-parish.
Any person operating a milk plant or milk products company who desires to sell, or offer for sale in the city-parish any fluid milk or milk products which are produced and pasteurized beyond the limits of the police jurisdiction of the city-parish shall obtain a permit from the health officer. No permit shall be issued to any applicant until the following standards are met:
(1)
The current United States Public Health Service survey rating of the applicant's pasteurized milk shall be as high as or higher than that of the city-parish as determined by the state milk survey officer, provided that a pasteurized milk score of 94.00 shall be deemed sufficient.
(2)
The applicant shall produce a letter from the health officer having local jurisdiction stating that the applicant meets the minimum requirements of the milk regulations for the state together with the complete laboratory results of the last four (4) samples of each of the products to be sold.
(3)
The applicant shall furnish the health office a sample of the labels for each size of each product to be sold. All such labels shall meet labeling requirements as set forth in the milk regulations for the state.
(4)
In addition to the above requirement the health officer, in order to be assured that these standards are met, may cause an inspection to be made of the applicant's plant and a representative sample of his producers. Such additional inspections as may be necessary for the proper enforcement of the provisions of this chapter may be ordered by the health officer.
(5)
For each inspection under the provisions of this section the applicant shall pay an inspection fee in the amount of thirty-five dollars ($35.00), which shall include inspection of his plant and those of his producers; the applicant shall also pay all travel expenses of the inspector at the rate prescribed by ordinances and resolutions then in effect governing travel expenses of persons performing travel on public business on behalf of the city-parish. All such fees and travel expenses shall be collected by the health officer prior to issuing any permit and shall be transmitted to the director of finance. Failure to pay the fee and travel expenses for an additional inspection shall result in automatic suspension of the permit until such sum is paid.
(6)
Upon issuance of a permit to an applicant the health officer shall take samples of each of the products being sold or offered for sale at the rate of not less than one each month. The grading of each product shall be in accordance with the grading of milk and milk products contained in the milk regulations for the state.
(7)
The provisions of subsections (1), (2), (3), (4) and (5) shall not apply to sterile milk, sterile milk products, hermetically sealed milk products, and manufactured milk products.
