§ 4:201. Misdemeanor summons issued, driver's license seized in lieu of bond.(City)
(a)
When it is lawful for a police officer to arrest at person without a warrant for a misdemeanor, he may give the written summons instead of making an arrest, if he has reasonable grounds to believe that the person will appear upon a summons. In any case in which a summons has been issued, a warrant of arrest may later be issued in its place.
(b)
A police officer authorized to make an arrest for any misdemeanor offense may require that the accused deposit his chauffeur's or operator's license incident to the issuance of a written summons. In such a case the officer shall issue a receipt for the license upon a form approved by the department of public safety, and thereafter the person shall be permitted to operate a motor vehicle upon the public highways of this state during the pendency of the case in which the license was deposited. The issuing police officer shall attach the license to the original summons which shall be promptly transmitted to the clerk of the city court in accordance with standard operating procedures. If the accused fails to appear in answer to the charge filed against him, the clerk shall promptly forward the license to the state department of public safety, which shall not return, reissue or renew the license until authorized to do so by the court.
