§ 4:59. Disposition of bicycles, go-carts and lawnmowers.

  • The chief of police is authorized, in his discretion, to dispose of bicycles, go-carts, and lawnmowers which are in the possession of the Baton Rouge Police Department either as found property or as recovered stolen property in accordance with the following guidelines:

    (a)

    Where the bicycle, go-cart or lawnmower is lawfully registered or can otherwise be identified as to ownership, the chief of police shall return the bicycle, go-cart, or lawnmower to the lawful owner thereof.

    (b)

    Where the lawful ownership of a bicycle, go-cart, or lawnmower cannot be established, the chief of police shall dispose of the bicycle, go-cart, or lawnmower in any one of the following methods:

    (1)

    The chief of police is authorized to dispose of bicycles, go-carts, or lawnmowers either individually or collectively through sale of the same to the highest bidder through a public bid process.

    (2)

    The chief of police may retain a bicycle, go-cart, or lawnmower or any component part thereof for the use of the Baton Rouge Police Department.

    (3)

    The chief of police may donate a bicycle or bicycles, go-cart, or go-carts, and lawnmower or lawnmowers or any component parts thereof to schools and institutions of learning or to charitable nonprofit organizations. Any school, institution or learning, or charitable organization receiving a bicycle, go-cart, or lawnmower under the provisions of this section shall remit unto the chief of police the appropriate fee and receive a registration sticker for the bicycle, go-cart, or lawnmower.
