§ 2:361. Denial or conditioning of discharges.
If any wastewater, wastes, or stormwaters are discharged, or proposed to be discharged, into the storm system when discharge(s):
(1)
Contain pollutants or exceed the limitations when provided for in this Chapter, state or federal regulations or permits;
(2)
have the potential to contribute a significant amount of pollutants which interfere with or cause maintenance problems of the storm sewer systems;
(3)
have the potential to contribute a significant amount of pollutants to the stormwater which would cause it to be out of compliance with state or federal water quality limits when applicable via EPA and DEQ regulations or permit requirements;
(4)
have the potential to contribute a significant amount of pollutants that would have a deleterious effect upon the storm sewer system or waters receiving stormwater discharges; or
(5)
which otherwise contributes a significant amount of pollutants or threaten to contribute contamination, pollution or nuisances which may endanger or create a hazard to public health, safety or welfare, then the Director may institute one or more of the following actions by written notice to the dischargers:
a.
Reject point source discharges;
b.
Require La. DEQ water quality discharge permits and NPDES Permits for point source and other regulated sites or dischargers;
c.
Require a city-parish general water quality discharge permit in cases where there is no state or federal discharge permit and where there is a potential of stormwater pollution or contamination.
d.
Require control over the quantities and rates of point source discharge through the issuance of a DEQ and NPDES permit or a city-parish compliance order;
e.
Require immediate discontinuance of the point source discharge until such time as it meets the requirements of this Chapter, State and Federal regulations or permits.
f.
Require, in cases of non-point source or point source stormwater discharge, the design and implementation of a stormwater management plan.
g.
Require compliance with other pertinent city-parish ordinances.
