§ 2:355. Disposal of derelict or abandoned aircraft on the premises of Baton Rouge Metropolitan Airport.

  • (a)

    Whenever any derelict or abandoned aircraft is found or located on premises owned or controlled by the City of Baton Rouge, Parish of East Baton Rouge, and/or the Greater Baton Rouge Airport District, whether or not such premises are under a lease or license to a third party, the Director of Aviation or the Director's designee shall make a record of the date the aircraft was found or determined to be present on the airport premises.

    (b)

    The Director of Aviation or the Director's designee shall contact the Federal Aviation Administration, Aircraft Registration Branch, to determine the name and address of the last registered owner of the aircraft and shall make a diligent personal search of the appropriate records, or contact an aircraft title search company, to determine the name and address of any person having an equitable or legal interest in the aircraft. Within 10 business days after receipt of the information, the Director of Aviation or the Director's designee shall notify the owner and all persons having an equitable or legal interest in the aircraft by certified mail, return receipt requested, of the location of the derelict or abandoned aircraft on the airport premises, that the aircraft has been determined to be abandoned and/or derelict, that the aircraft will be removed within 15 days receipt of notice of delivery of the letter by a wrecker service, and that the owner or interest holder will be liable for removal and storage fees imposed by the wrecker service if the owner and/or interest holders do not remove the aircraft prior to the deadline.

    (c)

    If the owner of the aircraft is unknown or cannot be found, the director of aviation or the director's designee shall cause a laminated notice to be placed upon such aircraft in substantially the following form: NOTICE TO THE OWNER AND ALL PERSONS INTERESTED IN THE ATTACHED PROPERTY. This property, to wit: (setting forth brief description) is unlawfully upon public property known as (setting forth brief description of location) and has been determined to be derelict and/or abandoned. Notice is hereby given that this aircraft will be removed from the premises by (name, address, and phone number of selected wrecker service) on the (date thirty (30) days from posting), and that the owner (s) and persons holding an interest in the aircraft will be liable for removal and storage fees imposed by the wrecker service if the owner and/or interest holders do not remove the aircraft prior to the (date thirty (30) days from posting). Dated this: (setting forth the date of posting of notice), signed: (setting forth name, title, address, and telephone number of agent of enforcing agency).

    Such notice shall be not less than eight (8) inches by ten (10) inches, shall provide the information set forth in English, and shall be sufficiently weatherproof to withstand normal exposure to the weather. If, at the end of thirty (30) calendar days after posting the notice, the owner or any person interested in the described derelict or abandoned aircraft has not removed the aircraft from the airport property, the director of aviation or the director's designee shall request the selected wrecker service to remove the aircraft and store it under such federal, state, and local regulations as may apply.
