§ 2:83. Same—Maintenance responsibility of parish; notice; rebuilding.(Parish)

  • (a)

    The maintenance responsibility of the parish in the case of "temporary streets or roads" shall be limited to the period of debt retirement or to five (5) years, whichever is the greater. Such streets or roads shall be eligible for public maintenance beyond this time limit only if such maintenance is declared to be "normal" by the department of public works. A list of such "extended" maintenance streets or roads shall be kept by the department of public works and a semi-annual report of them shall be submitted to the council. Whenever any such street or road is determined to be beyond normal maintenance, it must be reconstructed to the proper standard, as a part of the next following street or road paving program advertised by the parish government. It is the expressed policy of this government that temporary streets or roads are not eligible for indefinite maintenance.

    (b)

    The above paragraph shall be included on each and every petition prepared by the department of public works for construction of a "temporary street or road" and shall be specifically called to the attention of the person requesting and securing such petition; it being the intention of the council that all persons authorized to build a temporary street or road as defined in section 2:82 shall be advised of the maintenance policy applicable to such street or road once constructed.

    (c)

    In first class areas, streets or roads paved with temporary construction as defined in section 2:82, but completed prior to April 22, 1953, must be rebuilt with standard type construction when they have reached the limit of their useful life. The only exception shall be for the same reasons that exceptions would be granted under this part and then only after the process of public hearing has been satisfied.
