§ 11:55.1. Definitions.
The following words and phrases, when used in this chapter, shall have the following meanings:
Recorded image means a live video image recorded by a photographic monitoring system that depicts a vehicle overtaking or meeting a stopped school bus whose emergency stopped signals are operating while picking up or discharging passengers or in preparation for picking up or discharging passengers and is automatically recorded on a photographic or digital image showing the moving violation.
School bus safety enforcement program means a system that:
(1)
Consists of a monitoring system installed to work in conjunction with a school bus; and
(2)
Is capable of providing a view of live events from a remote location.
The viewer of live events provides a signed affidavit with supporting evidence, to include license plate and vehicle identification, that a motor vehicle was not operated in compliance with title 11, chapter 5, of the Code of Ordinances of the city and parish.
Sub image means an image that clearly shows and accurately reflects visible display of the license plate attached to the back of the vehicle as required by Louisiana law. The sub image must be clear so that there is no dispute to the accuracy of the image necessary to identify the violating vehicle.
System location means the G.P.S. location of the school bus on which is mounted the school bus safety enforcement program live stream video equipment.
Vehicle owner means the actual registered owner of the vehicle or any driver of the vehicle who reasonably appears to have authority to operate the vehicle. Vehicle owner also includes a lessee of a motor vehicle under a lease contract with an automobile dealership, or a lessee of a motor vehicle rented or leased from a motor vehicle rental or leasing company, but does not include the motor vehicle rental or leasing company itself.
Violation of this article means the failure of a driver of a vehicle to stop the vehicle, not less than thirty (30) feet from any school bus before reaching said school bus when the vehicle is meeting or overtaking from any direction said, school bus that has stopped for the purpose of receiving or discharging any passengers upon a public roadway and there are in operation on said school bus visual signals as required by law. Violation of this article also means the failure of any such driver to remain stopped and to not proceed until such school bus resumes motion or the visual signals are no longer activated.
