§ 11:291. Authority to impound or immobilize a vehicle.

  • Members of the city police department or their designated agents may immobilize or remove a vehicle from a street or highway to the nearest garage or other place of safety, or to a garage designated or maintained by the city police department or otherwise maintained by the city under the following circumstances:

    (1)

    When any vehicle is left unattended upon any street, highway or public property in such a manner as to cause a hazard or obstruction to traffic;

    (2)

    When any vehicle upon a street, highway or public property is so disabled as to constitute a hazard or an obstruction to traffic or the person in charge of a vehicle is, by reason of physical injury or arrest, incapacitated to such an extent as to be unable to provide for its custody or removal;

    (3)

    When any vehicle or bicycle is found abandoned or continuously unattended upon any street, highway, bridge or public property for a period in excess of five (5) days;

    (4)

    When any vehicle not possessing a valid and current safety inspection tag as required by Louisiana R.S. 32:1301—32:1310 is found to be in unsafe operating condition;

    (5)

    When any vehicle is left unattended upon a street, highway or public property and against which vehicle there are five (5) or more parking infractions in default status as defined in section 11:409 herein.
