§ 10:414. Certificate of convenience and necessity.

  • (a)

    In order to obtain a permit to operate an ambulance within the parish, the city administration, through the mayor-president or his/her designee, must issue a certificate of convenience and necessity, as required by section 10:406(7).

    (b)

    For the purpose of this chapter, "convenience and necessity" shall mean that there exists a current and permanent need for additional ambulance service in the parish.

    (c)

    If the mayor-president or his/her designee determine that there exists a convenience and necessity such as will justify the issuance of an additional ambulance service permit, prior to the issuance of that permit all current ambulance license holders shall be notified of the additional service needed and given an opportunity to provide that service. If the current ambulance license holders fail to provide the additional service within a reasonable time as determined by the mayor-president or his/her designee, the certificate of convenience and necessity shall issue, and an additional license may be issued.

    (d)

    If a certificate of convenience and necessity is denied by the mayor-president or his/her designee, the applicant may appeal to the metropolitan council for a public hearing on the denial.
