§ 10:412. Denial, suspension and revocation.

  • (a)

    Every owner or operator and every driver licensed under this chapter shall comply with all city, state and federal laws. Failure to do so will justify the department of EMS suspending or revoking the permit or license.

    (b)

    The city administration through the mayor-president or his/her designee may deny any applicant's permit or license whenever in the exercise of his/her reasonable and sound discretion, and after notice and affording the applicant a hearing thereon, the mayor-president or his/her designee shall determine that said applicant is not a fit and proper person to have such permit or license. The applicant may appeal within ten (10) days from such denial to the metropolitan council for a hearing by filing a request with the council administrator's office.

    (c)

    The department of EMS is hereby given authority to suspend any permit, certificate or license issued under this chapter for failure or refusal to comply with the provision of this chapter, such suspension to last for a period of not more than ten (10) days. The department of EMS is also given authority to revoke any permit, certificate or license for failure to comply with the provisions of this chapter; however, the permit, certificate or license may not be revoked unless the holder has received notice, has had an opportunity to present evidence on his/her behalf to the department, and has been given the opportunity to correct the deficiency within a reasonable time period.

    (d)

    Whenever a person who shall have been issued a permit or license under this chapter shall be charged with a violation of this chapter, the department of EMS and the finance director are hereby given authority to suspend the permit or license pending final disposition of the charges against him/her, and whenever a person who shall have been issued a permit or license under this chapter shall be convicted in any court with a misdemeanor involving moral turpitude, or with any felony, the department of EMS and the finance director are hereby given authority to revoke the permit or license.

    (e)

    Personnel licensed to perform at the advanced life support level in the parish found to be in violation of these provisions shall lose their certification to operate in the parish. No personnel will lose their license without an administrative hearing.
