§ 10:204.1. Regulation and inspections for pedicabs.

  • (a)

    Operating regulations. In addition to any other regulations imposed by this chapter or other law, a pedicab may be operated on any street where the posted speed limit is thirty-five (35) miles per hour or less and may cross any divided highway, highway, roadway, or street with a posted speed limit in excess of thirty-five (35) miles per hour at an intersection or may traverse any divided highway, highway, roadway, or street with a posted speed limit of not more than forty-five (45) miles per hour for a distance not exceeding one-quarter (¼) mile as a means of conveyance in connecting from one (1) divided highway, highway, roadway, or street where the posted speed limit is no more than thirty-five (35) miles per hour to another divided highway, highway, roadway, or street where the posted speed limit is no more than thirty-five (35) miles per hour.

    (b)

    Inspections. All pedicabs licensed under this chapter must be inspected annually for mechanical efficiency and proper registration tags during the month of August. Pedicabs which are licensed in other months must schedule an initial inspection and receive an inspection certificate/sticker prior to operating for hire. The inspections for mechanical efficiency shall be made by the central garage division of the department of public works and shall include:

    (1)

    Safety inspection covering brakes, windshield, lights, steering, tires, and suspension as may be applicable to the pedicab, and insurance and proper registration for all pedicabs, regardless of manufacture.

    (2)

    Be maintained to assure that it is mechanically dependable, clean, and safe.

    (3)

    Have a battery-operated headlight capable of projecting a beam of white light for a distance of five hundred (500) feet. The headlight shall be permanently affixed to the pedicab. Such lights may be removable and recharged.

    (4)

    Have taillights permanently affixed on the right and the left at the same level on the rear exterior of the passenger compartment. Taillights shall be red or amber in color and plainly visible from all distances within five hundred (500) feet to the rear of the pedicab. Such light may be removable and recharged. Taillights shall be mounted at the top rear corners of the passenger compartment or bench, and shall strobe or blink in a regular and discernible pattern, to ensure visibility and safety as may be determined by the inspector.

    (5)

    Have reflective panels mounted so as to be visible from the side of the vehicle, whether by application of reflective tape to the frame, fork, or passenger compartment, or by application of commercially available reflective panels, to ensure visibility and safety as may be determined by the inspector.

    (6)

    Have a disc brake or brakes and differential on the rear axle of the vehicle, if the pedicab is a tricycle or quadricycle design, or have such equipment on the trailer, if the pedicab is a tandem or trailer design.

    (7)

    Provide a seat belt for every passenger.

    (8)

    Be designed and manufactured so every passenger may enter and exit without crossing any interior barriers.
