Chapter 3. REGULATION OF VEHICLES FOR HIRE |
§ 10:201. Definitions.
The following words and phrases, when used in this chapter, shall have the meanings respectively ascribed to them:
Applicant, grantee or licensee shall mean any person which has bona fide legal title or control, direction, operation, maintenance, or supervision over any vehicle for hire operated upon the streets of the city-parish, or is a lessor of a vehicle for hire.
Association shall mean any organization which does not own the vehicles operating under its license, the membership of which is made up of individual operators, each of whom owns his own vehicle, and who are organized together under articles of agreement to provide mutual insurance coverage, central office facilities, telephone and maintenance service, and other like services for the mutual benefit of the individual members.
Driver or operator includes every person in charge of or operating any taxicab or vehicle as herein defined, either as owner, agent, employee, lessee or otherwise.
Limousine shall mean a chauffeur-driven luxury vehicle with a minimum seating capacity of six (6) but no more than fourteen (14), exclusive of the driver, which is used for the transportation of passengers for hire, excluding those limousines used by undertakers for the transportation only of persons attending a funeral; and which charges rates predetermined on a contractual basis and carrying passengers by prearrangement or contract.
Low speed vehicle or LSV shall mean a motorized vehicle operating by means of electric motor(s) or combustion engine with a maximum top speed of not less than twenty (20) nor more than twenty-five (25) miles per hour. LSV taxis shall conform to all insurance and liability requirements as provided by state law and this chapter.
Pedicab: A bicycle that has three or more wheels that transports, or is capable of transporting, passengers on seats attached to the bicycle that is operated by an individual, and that is used for transporting passengers for receipt of any form of consideration; or a bicycle with a singular unarticulated frame, that pulls a device that transports, or is capable of transporting, passengers on seats attached to a passenger cab or similar device, that is operated by an individual, and that is used for transporting passengers for receipt of any form of consideration.
Sightseeing or tourist guide vehicle shall mean a motor vehicle with an operator for hire and a minimum seating capacity of six (6), but no more than fourteen (14) persons, exclusive of the driver or the operator, which is used for the transportation of passengers for hire to various tourist destinations and other landmarks of interest in the parish.
Taxicab or vehicle for hire shall mean all motor vehicles or pedicabs (except the rental of cars without drivers, motor buses running and operating in established routes, limousines, sightseeing or tourist vehicles, and funeral vehicles) propelled or operated on, over or upon the public streets, alleys, highways, or boulevards of the city-parish for hire, carrying six (6) passengers or less, including the driver or operator thereof, which are subject to call from a garage, office, taxi stand or otherwise. Transportation network service operators and vehicles owned, used, or leased by transportation network service operators as defined by title 10, chapter 8, of the Code of Ordinances are specifically excluded from this definition.
Third person shall mean any person other than the driver, lessee or the owner of the vehicle.
